70 Year Old Individual Charged with Conspiracy Released with Time Served

In a recent federal case, the law firm represented a 70 year old individual charged with conspiracy to possess with intent to distribute marijuana. The client had a prior conviction, also in federal court, of possession with intent to distribute marijuana. Joffe and Joffe, PA was able to show that as a result of his client's age and deteriorating health that this client was at the eligibility age for release from the Federal Bureau of Prisons based upon BOP policy that encourages the release of inmates once they reach 70 years of age. The underlying philosophy of this policy is that inmates at this age cost the federal Bureau of prisons and ignored amount of money and medical and/or health care and that the prisons think that society is better served by having these individuals released back into the community. Mr. Joffe was successful in arguing to the trial judge that his client met requirements for release back into society and the Court sentenced his client a 13 month already served pretrial detention and place the client on an extended term of probation.
